1. Acceptance of Terms

By accessing or using Nebulix Cloud services, you agree to be bound by these Terms of Service. If you do not agree, do not use our services. We may update these Terms from time to time; continued use means you accept the changes.

2. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for safeguarding your credentials and for any activity on your account. Notify us immediately of any unauthorized access.

3. Services & Acceptable Use

Nebulix provides cloud hosting, storage, networking, and related infrastructure. You agree not to use the services for unlawful activity, to send spam, distribute malware, infringe intellectual property, or otherwise abuse the platform. We reserve the right to suspend accounts that violate this policy.

4. Billing & Renewal

Plans are billed in advance on a monthly or yearly cycle. All fees are non-refundable except as expressly stated. Subscriptions renew automatically unless cancelled at least 24 hours before the renewal date. Late payments may result in service suspension.

5. Service Level Agreement

We commit to a 99.99% monthly uptime SLA. If monthly uptime drops below this, eligible customers receive service credits per the SLA schedule. Scheduled maintenance and force majeure events are excluded.

6. Data, Privacy & Security

You retain ownership of all data you upload. We process data in accordance with our Privacy Policy and applicable laws including GDPR. We use industry-standard encryption in transit and at rest. You are responsible for maintaining backups of critical data.

7. Intellectual Property

Nebulix and its licensors own all rights, title, and interest in the services and underlying technology. You receive a limited, non-exclusive, non-transferable license to use the services in accordance with these Terms.

8. Termination

You may cancel at any time from your account. We may suspend or terminate accounts for material breach of these Terms, illegal activity, or non-payment. Upon termination, your data may be deleted after 30 days unless export is requested.

9. Limitation of Liability

To the maximum extent permitted by law, Nebulix is not liable for indirect, incidental, special, or consequential damages. Our aggregate liability is limited to the amount paid by you in the 12 months preceding the claim.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Disputes are subject to the exclusive jurisdiction of the state and federal courts located in Wilmington, Delaware.
